Compliance and Enforcement

We constantly strive to protect B.C. homebuyers: a key part of that work is ensuring that residential builders, homeowners and developers are in compliance with the Homeowner Protection Act and its regulations. 

To be in compliance means to adhere to all laws, legal regulations and requirements.

We promote voluntary compliance through education and awareness. If that can’t be achieved, we enforce the Act and its regulations through compliance orders, monetary penalties and by recommending charges through Crown counsel.

Our compliance efforts ensure:

  • Residential builders, homeowners and developers comply with the licensing requirements of the Act
  • Homes being built or sold in B.C. are covered by home warranty insurance where required, or are properly exempt from the Act’s licensing and home warranty insurance requirements.
  • All disclosure requirements related to the Act are met.

Our objectives

Our primary objective is to achieve voluntary compliance with the Act’s requirements through education and awareness. This includes:

  • Providing regulatory bulletins to help builders and others better understand the Act and its regulations
  • Using real-life case studies to help builders and others understand how to comply with the Act
  • Communicating information to building departments and other stakeholders
  • Participating in industry events
  • Making presentations to realtors
  • Sending information letters to stakeholders

Stakeholders

We work with a variety of stakeholders to ensure compliance with the Act and its regulations. Primarily, we do this by working with builders across B.C. to increase protection for buyers of new homes. However, we also work with a number of other partners as part of our ongoing awareness and education efforts, to ensure consumer protection measures are upheld.

Real estate licensees

BC Housing and the Real Estate Council of British Columbia signed an Information Sharing Agreement, which became effective on June 6, 2013. The Agreement allows both organizations to share information about their respective licensees to help each other effectively regulate their areas of responsibility.

Please be advised that we may copy the Real Estate Council on information letters regarding potentially non-compliant sales that we send to real estate licensees and managing brokers.
