Zorawer Singh Sandhar and Balbir Kaur Sandhar 

On June 16, 2021, pursuant to s. 28.3(1)(b) of the Homeowner Protection Act (the “Act”), Zorawer Singh Sandhar (“Z.  Sandhar”) and Balbir Kaur Sandhar (“B. Sandhar”), jointly and severally, were issued a monetary penalty in a single amount of $7,000.00. This Monetary Penalty was issued for the following reasons: 

• Z.  Sandhar and B. Sandhar (together, “the Sandhars”), contrary to s. 22(1) of the Act, constructed a new home in Surrey, BC (the “New Home”), between the period of, or about, January 13, 2016, and June 27, 2018, without the New Home being registered for coverage by home warranty insurance (“HWI”) provided by a warranty provider; 
• The contravention of the Act by the  Sandhars is the subject of Compliance Order 18-0064 (the “CO”) issued by BCH on August 17, 2018. The date for complying with the CO was September 28, 2018; 
• The CO directed the Sandhars, amongst other things, to immediately either register the New Home for coverage by HWI provided by a warranty provider pursuant to s. 22(1) of the Act; provide BCH with proof that the New Home was built by a LRB and is enrolled in HWI pursuant to s. 22 of the Act; or apply for, and be issued, an Owner Builder Authorization for the New Home; and  
• The Sandhars failed to comply with any of the orders contained in the CO by the requested compliance date.
