Compliance Order
Issue Date
On August 11, 2021, pursuant to s. 28.3(1)(b) of the Homeowner Protection Act (the “Act”), Woojung Chung (“Chung”) was issued a monetary penalty in the single amount of $7,475. This Monetary Penalty was issued for the following reasons:
- Chung, contrary to section 14(1) of the Act, built or caused to have built a new home in West Vancouver, BC, (the “New Home”) between the period of, or about, June 2017 and January 2020, without being a BC Housing (“BCH”) Licensed Residential Builder (“LRB”), and without the New Home being registered for coverage by Home Warranty Insurance (“HWI”) since the New Home was de-enrolled from HWI coverage on June 5, 2018, contrary to section 22(1) of the Act;
- The contraventions of the Act by Chung are the subject of Compliance Order 20-0003 (the “CO”) issued by BCH on January 17, 2020. Amongst other things, the CO directed Chung to cease construction on the New Home and to either become a LRB and register the New Home for coverage by HWI, or provide proof that the New Home is covered by HWI;
- On November 12, 2020, BCH issued Amended Compliance Order 20-0003-1 (the “ACO”) to Chung in an effort to allow Chung more time to comply with the requested action. All conditions and requirements stated in the CO remained the same, except the date for compliance was extended to December 11, 2020, from February 14, 2020; and
- Chung failed to comply with the orders contained in the ACO by the requested compliance date.
