Watton Homes Ltd. (“WHL”) and Ron Watton (“Watton”), contrary to section 14(1) of the Homeowner Protection Act (the “Act”), conducted the business of a residential builder between the period of, or prior to, December 29, 2015, and March 24, 2016, without being a Homeowner Protection Office (“HPO”) Licensed Residential Builder (“LRB”). On March 24, 2016, the HPO issued Compliance Order 16-0011 to WHL and Watton directing that WHL and Watton:
- Cease carrying on the business of a residential builder as defined in the Act. More specifically, cease engaging in, arranging for or managing the construction of any new home, including such activities as receiving a building permit(s) for new home construction, commencing construction of a new home, continuing construction of a new home, offering to sell or selling a new home or contracting, or otherwise agreeing, to build a new home for an owner or developer, and specifically includes the construction project located in West Vancouver, BC;
- Cease the above noted activities until such time as WHL and Watton have been issued a Residential Builder Licence by the HPO pursuant to section 14(1) of the Act; and
- Immediately become an HPO LRB pursuant to section 14(1) of the Act.
WHL and Watton were directed to comply with Compliance Order 16-0011 by April 22, 2016.
