Trevor Lee Mosher (“Mosher”), contrary to section 14(1) and section 22(1) of the Homeowner Protection Act (the “Act”), built a new home in Hudson’s Hope, B.C., (the “New Home”), during the period of, or about, 2009 and 2013, without being a Homeowner Protection Office (“HPO”) Licensed Residential Builder (“LRB”), and without the New Home being covered by a policy of home warranty insurance. On January 18, 2013, the HPO issued Compliance Order 13-0001 to Mosher directing that Mosher:
- apply for, and become, a LRB pursuant to section 14(1) of the Act, and enrol the New Home with home warranty insurance pursuant section 22(1) of the Act or, apply for be issued, an Owner Builder Authorization (“OBA”) for the New Home on the Property pursuant section 20(1) of the Act and section 4.1(2) of the Homeowner Protection Act Regulations (the “Regulations”), and fulfil the requirements of being an owner builder; and
- does not sell, or offer to sell, the New Home unless the New Home is enrolled with home warranty insurance, or an OBA and an Owner Builder Disclosure Notice have been issued with respect to the New Home.
Mosher was directed to comply with Compliance Order 13-0001 by February 22, 2013.
