Sukhpal Singh Sran (“Sran”), contrary to sections 20.1(1)(b) and 21(2)(a) of the Homeowner Protection Act (the “Act”), regarding a new home in Surrey, B.C. (the “New Home”), for which an Owner Builder Authorization (“OBA”) had been issued, sold the New Home within the 12-month period after the New Home was built, and failed to provide the purchasers of the New Home with a disclosure notice in a form satisfactory to the Homeowner Protection Office (“HPO”) Registrar, stating among other facts, whether or not the New Home was covered by home warranty insurance. On November 20, 2015, the HPO cancelled the OBA that had been issued to Sran for the New Home. On March 18, 2016, Sran was issued Compliance Order 16-0017. On April 4, 2016, the HPO issued Amended Compliance Order 16-0017-1 to Sran changing the compliance date to April 29, 2016, and directing that Sran:
- immediately register the New Home for coverage by home warranty insurance provided by a warranty provider pursuant to section 22(1) of the Act under HPO Licensed Residential Builder (“LRB”) 38265 of which Sran is the sole licensee; or
- provide the HPO with proof that the New Home was built by an HPO LRB and is enrolled in a policy of home warranty insurance pursuant to section 22 of the Act.
Sran was directed to comply with Amended Compliance Order 16-0017-1 by April 29, 2016.
