Subros Homes Ltd. (“SHL”), Yang Su (“Y. Su”) and Bilan Su (“B. Su”), contrary to section 14(1) of the Homeowner Protection Act (the “Act”), conducted the business of a residential builder without a valid BC Housing (“BCH”) Residential Builder Licence between the period of, or about, June 30, 2018, and February 10, 2020, regarding two new homes in Vancouver and two new homes in Coquitlam, BC (collectively, the “New Homes”). On February 10, 2020, BCH issued Compliance Order 20-0008 to SHL, Y. Su and B. Su directing that SHL, Y. Su and B. Su:
- immediately cease carrying on the business of a residential builder as defined in the Act, and cease construction activities on each of the New Homes;
- immediately apply for and become a BCH Licensed Residential Builder (“LRB”) pursuant to section 14(1) of the Act; and
- prior to resuming construction on any of the New Homes, provide BCH Compliance Department with proof that each of the New Homes is being built by a LRB pursuant to section 14(1) of the Act.
SHL, Y. Su and B. Su were directed to comply with Compliance Order 20-0008 by February 28, 2020.
