Rodney Jay Sawatsky (“Sawatsky”) dba Prime Time Enterprises, contrary to section 14(1) of the Homeowner Protection Act (the “Act”), conducted the business of a residential builder without a valid BC Housing (“BCH”) Residential Builder Licence, between the dates of, or about, December 31, 2017, and March 16, 2018, with respect to two new homes, one in West Kelowna and one in Summerland, B.C. (collectively, the “New Homes”). On March 16, 2018, BCH issued Compliance Order 18-0025 to Sawatsky directing that Sawatsky:

  • immediately cease carrying on the business of a residential builder as defined in the Act, and cease construction activities on the New Homes; and
  • prior to resuming construction on any of the New Homes, provide BCH Compliance Department with proof that each of the New Homes is being built by a Licensed Residential Builder pursuant to section 14(1) of the Act.

Sawatsky was ordered to comply with Compliance Order 18-0025 by April 6, 2018.
