Rajinder Sahota (“Sahota”) and Dholpur Holdings Ltd. (“DHL”), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (the “Act”), constructed a multi-unit building in Victoria, BC (the ‘New Homes”), without a valid Homeowner Protection Office (“HPO”) Residential Builder Licence and without each of the New Homes being registered for coverage by home warranty insurance provided by a warranty provider. On November 1, 2016, the HPO issued Compliance Order 16-0027 to Sahota and DHL directing that Sahota and DHL:

  • Immediately cease carrying on the business of a residential builder as defined by the Act; and
  • Immediately become an HPO Licensed Residential Builder pursuant to section 14(1) of the Act and enrol each of the New Homes in home warranty insurance pursuant to section 22(1) of the Act; or arrange for a restrictive covenant to be registered on the title to the property restricting the sale or other disposition of any of the New Homes for 10 years from the date of first occupancy of a dwelling unit in the New Homes pursuant to section 2(2) of the Homeowner Protection Act Regulation.


Sahota and DHL were directed to comply with Compliance Order 16-0027 by December 1, 2016. Complied.
