Prime B Custom Homes Ltd. (“PBCHL”) and Parmjit Kaur Bal (“Bal”) constructed a new home in Surrey, B.C. (the “New Home”), between the period of, or about, April 2, 2015, and September 13, 2017. Although PBCHL was approved as a BC Housing (“BCH”) Licensed Residential Builder (“LRB”) (36564) between December 14, 2012, and December 31, 2015, and obtained a commitment from an approved home warranty insurer on July 4, 2014, to provide home warranty insurance (“HWI”) on the New Home as required by the Homeowner Protection Act (the “Act”) and the Homeowner Protection Act Regulation, the New Home was de-enrolled from HWI coverage by the home warranty insurer on September 13, 2017, contrary to section 22(1) of the Act. Since April 5, 2016, PBCHL has been approved as LRB 42332. On December 5, 2017, BCH issued Compliance Order 17-0043 to PBCHL and Bal directing that PBCHL and Bal:
- immediately register the New Home for coverage by HWI provided by a warranty provider pursuant to section 22(1) of the Act.
PBCHL and Bal were ordered to comply with Compliance Order 17-0043 by December 29, 2017.
