Monetary Penalty
Issue Date
On July 7, 2021, pursuant to s. 28.3(1)(a) of the Homeowner Protection Act (the “Act”), s. 20.1(2)(d) and s. 20.1(2)(e) of the Homeowner Protection Act Regulation (the “Regulation”), Pravin Kumar (“Kumar”) was issued a monetary penalty in the single amount of $3,400. This Monetary Penalty was issued for the following reasons:
- Kumar, contrary to s. 20.1(1)(b) and s. 21(2)(a) of the Act, regarding a new home in Vancouver, BC (the “New Home”), for which an Owner Builder Authorization had been issued, sold the New Home on, or about, June 12, 2020, within the 12-month period after the New Home was built, and failed to provide the prospective purchaser of the New Home, prior to the sale of the New Home, a disclosure notice in a form satisfactory to the BC Housing Registrar, stating, among other facts, whether or not the New Home was covered by a policy of home warranty insurance; and
- The contraventions of the Act by Kumar make Kumar subject to a monetary penalty pursuant to s. 28.3(1)(a) of the Act, s.20.1(2)(d) and s. 20.1(2)(e) of the Regulation.
