Prairie Creek Homes Inc. (“PCH”) and Daniel Peter Friesen (“Friesen”), contrary to section 22(1) of the Homeowner Protection Act (the “Act”), built or caused to have built a new home in Sorrento, BC (the “New Home”), during the period of, or about, December 16, 2017, to the Fall of 2018, without the New Home being registered for coverage by home warranty insurance (“HWI”) provided by a warranty provider. Although PCH was a Licensed Residential Builder (“LRB”)(42606) during that period, LRB 42606 expired on August 31, 2020. On October 21, 2020, BCH issued Compliance Order 20-0021 to PCH and Friesen directing that PCH and Friesen:
- Ensure PCH, LRB42606, is in good standing; and
- Immediately:
- register the New Home for coverage by HWI provided by a warranty provider pursuant to section 22(1) of the Act; or
- provide BCH Compliance Department with proof that the New Home is enrolled in a policy of HWI pursuant to section 22 of the Act.
PCH and Friesen were ordered to comply with Compliance Order 20-0021 by November 27, 2020.
