Maya Homes Ltd. (“MHL”), and Sukhdip S Hayre (“Hayre”), contrary to section 14(1) of the Homeowner Protection Act (the “Act”), conducted the business of a residential builder without a valid BC Housing (“BCH”) Residential Builder Licence between the period of, or about, May 31, 2022, and October 12, 2022, regarding a new home in Coquitlam, a new home in White Rock, and two new homes in Surrey, BC (collectively, the “New Homes”). On October 12, 2022, BCH issued Compliance Order 22-0024 to MHL and Hayre directing that MHL and Hayre:
- cease carrying on the business of a residential builder as defined in the Act, and cease construction activities on the New Homes;
- immediately apply for and become a BCH Licensed Residential Builder (“LRB”) pursuant to section 14(1) of the Act; and
- cease the above-noted activities until such time as MHL and Hayre become a BCH LRB pursuant to section 14(1) of the Act.
MHL and Hayre were directed to comply with Compliance Order 22-0024 by November 25, 2022.
