Matthew Huber (“Huber”), contrary to 14(1) and 22(1) of the Homeowner Protection Act (the “Act”), built or caused to have built a new home in Abbotsford, BC (the “New Home”), during the period of, or about, May 11, 2017, and November 7, 2017, without being a BC Housing (“BCH”) Licensed Residential Builder (“LRB”) and without the New Home currently being registered for coverage by home warranty insurance (“HWI”) provided by a warranty provider. On November 7, 2017, BCH issued Compliance Order 17-0039 to Huber directing that Huber:

  • immediately cease carrying on the business of a residential builder as defined in the Act. More specifically, Huber was ordered to cease engaging in, arranging for or managing the construction of any new home, including such activities as receiving a building permit(s) for new home construction, continuing construction of a new home, advertising as a residential builder, offering to sell or selling a new home, or contracting, or otherwise agreeing, to build a new home for an owner or developer; and
  • immediately apply for and become a BCH LRB pursuant to section 14(1) of the Act, and register the New Home for coverage by HWI provided by a warranty provider pursuant to section 22(1) of the Act.

Huber was ordered to comply with Compliance Order 17-0039 by November 24, 2017. Complied.
