Monetary Penalty
Issue Date
On February 15, 2017, pursuant to s. 28.3(1)(a) of the Homeowner Protection Act (the “Act”) and s.20.1 (2)(e) of the Homeowner Protection Act Regulation (the “Regulations”), Kuljit Singh Boughan (“Boughan”), was issued a monetary penalty in the single amount for $6,000. This Monetary Penalty was issued for the following reasons:
- Boughan, contrary to s. 21(2)(a)of the Act, regarding a new home in Surrey, BC (the “New Home”), for which an Owner Builder Authorization had been issued, sold the New Home on, or about, June 25, 2015, without providing the prospective purchasers of the New Home with a disclosure notice, in a form satisfactory to the Registrar of BC Housing (“BCH”) - formerly the Homeowner Protection Office - stating among other facts, whether or not the New Home was covered by home warranty insurance; and
- The contravention of the Act by Boughan makes Boughan subject to a monetary penalty pursuant to s. 28.3(1)(a) of the Act and s. 20.1(2)(e) of the Regulations.
