Kanani Development Ltd. (“KDL”), Inderjit Singh Basra (“I. Basra”), and Jasbir Singh Basra (“J. Basra”), contrary to section 22(1) of the Homeowner Protection Act (the “Act”), built a new home in Port Coquitlam, B.C. (the “New Home”), between the period of, or about, February 29, 2012, the date the New Home was de-enrolled from home warranty insurance coverage, and October 2012, without the New Home being covered by a policy of home warranty insurance. Although KDL was a Homeowner Protection Office (“HPO”) Licensed Residential Builder (“LRB”) between September 14, 2012, and December 2, 2013, KDL, I. Basra and J. Basra failed to register the New Home for coverage by home warranty insurance provided by a warranty provider. On January, 05, 2015, the HPO issued Compliance Order CO15-0001 to KDL, I. Basra, and J. Basra directing that KDL, I. Basra, and J. Basra immediately:
- apply for and become an HPO LRB pursuant to section 14(1) of the Act, and
- register the New Home for coverage by home warranty insurance provided by a warranty provider pursuant to section 22(1) of the Act.
KDL, I. Basra, and J. Basra were directed to comply with Compliance Order 15-0001 by February 6, 2015.
