Juhl Campbell (“J. Campbell”), contrary to section 22(1.1) (b) of the Homeowner Protection Act (the “Act”), offered/ marketed for sale two new homes in Boswell, B.C. (the “New Homes”), between the dates of April 7, 2012 and June 20, 2012, without either of the New Homes being covered with a policy of home warranty insurance pursuant to section 22 of the Act. On July 23, 2012, the Homeowner Protection Office (“HPO”) issued Compliance Order 12-0038 to J. Campbell directing that the offering for sale, marketing, completion of any Purchase/Sale Agreement that may be in place, or already in place, and/ or actual sale of the New Homes cease immediately, provide the HPO evidence of the sale offering cancellations for the New Homes, and ensure that each of the New Homes is enrolled with a policy of home warranty insurance pursuant to section 22 of the Act, or be granted permission by the registrar of the HPO, pursuant to section 22 (1.2) of the Act, authorizing J. Campbell to sell, or offer to sell, one or both of the New Homes despite the requirements of section 22 (1.1) of the Act, prior to renewing any marketing efforts and/or offering either of the New Homes for sale, or in the case of a Purchase and Sale Agreement already being in place for the New Homes, prior to selling either of the New Homes. J. Campbell was directed to comply with Compliance Order 12-0038 by August 24, 2012. Complied.
