Judith L. Kwiatkowski (“J. Kwiatkowski”), Dennis Kwiatkowski (“D. Kwiatkowski”) (together, “the Kwiatkowskis”), and BC0385770 dba Denny’s Woodwork & Construction Ltd. (“DWCL”) constructed a new home in Quesnel, BC (the “New Home”), between the period of, or about, July 29, 2011, and May 6, 2013. Although DWCL was approved as Homeowner Protection Office (“HPO”) Licensed Residential Builder 22512 between November 25, 2002, and March 4, 2013, and has been approved as HPO LRB 37339 since May 22, 2014, contrary to section 22(1) of the Homeowner Protection Act (the “Act”), DWCL and the Kwiatkowskis failed to register the New Home for coverage by home warranty insurance provided by a warranty provider. On October 28, 2014, Compliance Order 14-0059 was issued by the HPO to the Kwiatkowskis and DWCL directing that the Kwiatkowskis and DWCL:
- immediately register the New Home for coverage by home warranty insurance provided by a warranty provider pursuant to section 22(1) of the Act.
The Kwiatkowskis and DWCL were directed to comply with Compliance Order 14-0059 by November 21, 2014.
