Jeremy Henk Goosen (“Goosen”), contrary to section 20.1(1)(b) of the Homeowner Protection Act (the “Act”), sold a new home in Chilliwack, B.C. (the “New Home”), for which an Owner Builder Authorization (“OBA”) had been issued, without having occupied the New Home for the 12-month period after it was built. On May 15, 2013, the Homeowner Protection Office (“HPO”) cancelled the OBA that had been issued to Goosen for the New Home. On March 21, 2014, the HPO issued Compliance Order 14-0023 to Goosen, directing that Goosen:
- immediately become an HPO LRB pursuant to section 14(1) of the Act; and
- register the New Home for coverage by home warranty insurance provided by a warranty provider pursuant to section 22(1) of the Act.
Goosen was directed to comply with Compliance Order 14-0023 by April 25, 2014.
