Summary for CO 20-0024
Jaswant Rakhra (“J. Rakhra”) and Surjit Rakhra (“S. Rakhra”), contrary to section 22(1) of the Homeowner Protection Act (the “Act”), resumed or caused construction to resume on two new homes in Vancouver, BC (the “New Homes”) between October 21, 2020, and December 16, 2020, without each of the New Homes being covered by a policy of home warranty insurance (“HWI”). Each of the New Homes was registered for coverage by HWI provided by a warranty provider on January29, 2016, as required by the Act and the Homeowner Protection Act Regulation. Construction commenced on the New Homes and then the New Homes were de-enrolled from HWI coverage by the warranty provider on October 21, 2020. It was found construction stopped and then resumed on the New Homes sometime after October 21, 2020. On December 16, 2020, BCH issued Compliance Order 20-0024 to J. Rakhra and S. Rakhra directing that J. Rakhra and S. Rakhra:
- Ensure all construction activities cease immediately on the New Homes;
J. Rakhra and S. Rakhra were ordered to comply with Compliance Order 20-0024 by January 8, 2021.
