J. A. Construction Ltd. (“JACL”) and Jasvir Gill (“Gill”), contrary to schedule 3 section 6(2) of the Homeowner Protection Act Regulation (the “Regulations”), regarding a new home in Surrey, B.C. (the “New Home”), for which the New Home was occupied as a rental unit, sold the New Home on, or about, June 18, 2013, without disclosing, in writing, to the purchaser of the New Home, the date on which the home warranty insurance expires. On December 18, 2014, the Homeowner Protection Office (the “HPO”) issued Compliance Order 14-0068 to JACL and Gill directing that JACL and Gill:
- provide the HPO with proof that JACL and Gill provided written disclosure to the purchaser of the New Home showing the date on which the home warranty insurance expires, pursuant to schedule 3 section 6(2) of the Regulations; and
- provide the HPO with documentary evidence that the New Home was occupied for rental purposes prior to the Property being sold on, or about, June 18, 2013.
JACL and Gill were directed to comply with Compliance Order 14-0068 by January 16, 2015.
