Island Dream Builders Inc (“IDBI”), Darren Gaudreault (“D. Gaudreault”), Marcel Gaudreault (“M.A. Gaudreault”), and Monica Gaudreault (“M.O. Gaudreault”), contrary to sections 22(1) of the Homeowner Protection Act (the “Act”), built or caused to have built a new home in Qualicum Beach, B.C. (the “New Home”) between 2011 and 2012, without the New Home being registered for coverage by home warranty insurance provided by a warranty provider. On May 30, 2013, Compliance Order 13-0024 was issued by the HPO to IDBI, D. Gaudreault, M.A. Gaudreault, and M.O. Gaudreault directing that IDBI, D. Gaudreault, M.A. Gaudreault, and M.O. Gaudreault:
- immediately register the New Home for coverage by home warranty insurance provided by a warranty provider pursuant to section 22(1) of the Act; or
- provide the HPO with proof that the New Home is enrolled in a policy of home warranty insurance pursuant to section 22(1)of the Act;
IDBI, D. Gaudreault, M.A. Gaudreault, and M.O. Gaudreault were directed to comply with Compliance Order 13-0024 by July 5, 2013. Complied.
