Huber Construction Ltd. (“HCL”) and Bernard Huber (“B. Huber”), contrary to section 22(1) of the Homeowner Protection Act (the “Act”), constructed, or caused to have constructed, a new home in Kelowna, BC, without the New Home being registered for coverage by home warranty insurance (“HWI”) provided by a warranty provider. On September 11, 2017, BC Housing (“BCH”) issued Compliance Order 17-0030 to HCL and B. Huber directing that HCL and B. Huber:
- ensure HCL’s Residential Builder Licence (43517) remains in approved status, and immediately register the New Home for coverage by HWI provided by a warranty provider, and ensure that a policy of HWI is issued for the New Home pursuant to section 22(1) of the Act; or
- provide BCH Compliance Department with proof that the New Home is currently enrolled in a policy of HWI pursuant to section 22(1) of the Act.
HCL and B. Huber were directed to comply with Compliance Order 17-0030 by October 2, 2017.
