House & Castle Construction Ltd. (“HCCL”) and Davied Broderick(“Broderick”), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (the “Act”), built a new home in Blind Bay, B.C. (the “New Home”) from, or around, 2008 to 2009, without being a Homeowner Protection Office (“HPO”) Licensed Residential Builder (“LRB”) and without the New Home being registered for coverage by home warranty insurance provided by a warranty provider. Although HCCL was an approved HPO LRB between the dates of November 20, 2006, and November 30, 2007, HCCL’s HPO licence was closed on May 22, 2008, prior to construction of the New Home being substantially completed by HCCL. On May 12, 2014, the HPO issued Compliance Order 14-0030 to HCCL and Broderick directing that HCCL and Broderick:

  • immediately apply for and become an HPO LRB pursuant to section 14(1) of the Act, and immediately register the New Home for coverage by home warranty insurance provided by a warranty provider pursuant section 22(1) of the Act; or
  • apply for, and be issued, an Owner Builder Authorization for the New Home pursuant section 20(1) of the Act and section 4.1(2) of the Homeowner Protection Act Regulation, and fulfil the requirements of being an owner builder.

HCCL and Broderick were directed to comply with Compliance Order 14-0030 by June 27, 2014.
