Gurdeep Kainth and Symphony Homes Limited

On April 4, 2013, pursuant to s. 28.3(1)(a) of the Homeowner Protection Act (the “Act”), and s. 20.1(2)(f) of the Homeowner Protection Act Regulation (the “Regulations”), Gurdeep Kainth (“Kainth”) and Symphony Homes Limited (“SHL”), were issued a monetary penalty, jointly and severely, in the single amount of $2,800. This Monetary Penalty was issued for the following reasons:

• Kainth and SHL, contrary to s. 22(1) of the Act, commenced construction and continued construction on four new homes located in North Vancouver, BC (collectively, the “New Homes”), between July 28, 2011, and November 16, 2012, without any of the New Homes being registered for coverage by home warranty insurance provided by a warranty provider; and
• The contravention of the Act by Kainth and SHL makes Kainth and SHL subject to a monetary penalty pursuant to s. 28.3(1)(a) of the Act and s. 20.1(2)(f) of the Regulations.
