Farhad Farzady (“F. Farzady”) constructed a new home in North Vancouver, BC (the “New Home”), between the period of, or about, October 11, 2013, and January 5, 2015. Although F. Farzady held a valid Homeowner Protection Office (“HPO”) Residential Builder Licence (#34312), and obtained a commitment from an approved home warranty insurer on October 7, 2013, to provide home warranty insurance on the New Home as required by the Homeowner Protection Act (the “Act”) and the Homeowner Protection Act Regulation, the New Home was de-enrolled from home warranty insurance coverage by the home warranty insurer on February 24, 2015, contrary to section 22(1) of the Act. On March 5, 2015, Compliance Order 15-0015 was issued by the HPO to F. Farzady, directing that F. Farzady:
- register the New Home for coverage by home warranty insurance provided by a warranty provider pursuant to section 22(1) of the Act.
F. Farzady was directed to comply with Compliance Order 15-0015 by April 3, 2015.
