Darcy Finch (“Finch”) built a new home in Hixon, BC, (the “New Home”) sometime between April 2008, and May 2012, without being a Homeowner Protection Office (“HPO”) Licensed Residential Builder (“LRB”) and without the New Home being covered by a policy of home warranty insurance. On May 24, 2012, the HPO issued Compliance Order (“CO”) 12-0021 to Finch directing that he become an HPO LRB pursuant to section 14 of the Homeowner Protection Act (the “Act”) and obtain home warranty insurance for the New Home pursuant to section 22 of the Act. Finch was directed to comply with CO 12-0021 by July 20, 2012. On June 6, 2012, the HPO issued Amended Compliance Order 12-0021-1 to Finch modifying the orders contained in CO12-0021 to also include the additional option of obtaining compliance by applying for, and being issued an Owner Builder Authorization (“OBA”) pursuant to section 20(1) of the Act and fulfilling the requirements of being an owner builder. All of directions contained in CO12-0021 remain unchanged.
