Daniel Louise Saulnier (“D. Saulnier”) and Louise Agatha Saulnier (“L. Saulnier”), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (the “Act”), built, or caused to have built, a new home in Vanderhoof, B.C. (the “New Home”), during the period of, or about, 2007 and 2008, without being a Homeowner Protection Office (“HPO”) Licensed Residential Builder (“LRB”) and without the New Home being covered by a policy of home warranty insurance. On November 1, 2012, the HPO issued Compliance Order 12-0050 to D. Saulnier and L. Saulnier (together, “the Saulniers”), directing that the Saulniers:
- cease the offering for sale, marketing, completing of any Sale Agreement and/or actual sale of the New Home and provide the HPO evidence that any sale offerings and Sale Agreements that have been entered into with respect to the New Home have been cancelled; and either
- become an HPO LRB pursuant to section 14 of the Act and obtain home warranty insurance for the New Home pursuant to section 22 of the Act; or
- apply for, and be issued, an Owner Builder Authorization for the New Home pursuant to section 20(1) of the Act and section 4.1(2) of the Homeowner Protection Act Regulation, and fulfil the requirements of being an owner builder; or
- if the Saulniers did not arrange for, or engage in, all or substantially all of the construction of the New Home, provide the HPO with evidence to show who arranged for, or managed all or substantially all, of the construction of the New Home.
The Saulniers were directed to comply with Compliance Order 12-0050 by December 7, 2012. Complied.
