Carol Ann Jensen (“C.A. Jensen”) and Cory Kristofor Jensen (“C.K. Jensen”) (together, the “Jensens”), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (the “Act”), built a new home in Birch Island, B.C., (the “New Home”) in, or around, 2009 and 2010 without being a Homeowner Protection Office (“HPO”) Licensed Residential Builder (“LRB”) and without the New Home being covered by a policy of home warranty insurance. On February 13, 2012, the HPO issued Compliance Order 12-0008 to C.A. Jensen and C.K. Jensen directing that the Jensens either become an HPO LRB pursuant to section 14 of the Act and obtain home warranty insurance for the New Home pursuant to section 22 of the Act, or the Jensens provide proof that the New Home was built by an HPO LRB and is enrolled with home warranty insurance pursuant to section 22 of the Act, or that C.A. Jensen or C.K. Jensen apply for, and be issued, an Owner Builder Authorization (“OBA”) for the New Home pursuant to section 20 (1) of the Act and section 4.1 (2) of the Homeowner Protection Act Regulation (the “ Regulations”), and fulfil the requirements of being an owner builder. The Jensens were directed to comply with Compliance Order 12-0008 by April 20, 2012.
