Ben Bouchard Contracting Ltd. (“BBCL”), Benoit Raymond Bouchard (“B. Bouchard”) and Nancy Bouchard (“N. Bouchard”), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (the “Act”), built or caused to have built a new home in Powell River, BC (the “New Home”), sometime prior to November 2, 2017, without being a BC Housing (“BCH”) Licensed Residential Builder (“LRB”) and without the New Home being registered for coverage by home warranty insurance (“HWI”) provided by a warranty provider. On January 15, 2018, BCH issued Compliance Order 18-0002 to BBCL, B. Bouchard and N. Bouchard directing that BBCL, B. Bouchard and N. Bouchard:
- immediately cease carrying on the business of a residential builder as defined in the Act. More specifically, BBCL, B. Bouchard and N. Bouchard were ordered to cease engaging in, arranging for or managing the construction of any new home, including such activities as receiving a building permit(s) for new home construction, continuing construction of a new home, advertising as a residential builder, offering to sell or selling a new home, or contracting, or otherwise agreeing, to build a new home for an owner or developer; and
- immediately apply for and become a BCH LRB pursuant to section 14(1) of the Act, and register the New Home for coverage by HWI provided by a warranty provider pursuant to section 22(1) of the Act.
BBCL, B. Bouchard and N. Bouchard were ordered to comply with Compliance Order 18-0002 by February 2, 2018.
