A0055278 dba VIA Mortgage Investment Corporation, Todd Hickling, John Lopez and Anne Ambroziewicz

On July 3, 2014, pursuant to s. 28.3 (1)(a ) of the Homeowner Protection Act (the “Act”), s. 20.1(2)(b) and s. 20.1(2)(g) of the Homeowner Protection Act Regulation (the “Regulations”), A0055278 dba VIA Mortgage Investment Corporation (“VIA”), Todd Hickling (“Hickling”), John Lopez (“Lopez”) and Anne Ambroziewicz (“Ambroziewicz”), jointly and severally, were issued a monetary penalty in the daily amount of $260 to a maximum of $7,800, for each day that passes where the contraventions of s. 14(1) and s. 22(1.1) of the Act continued. This Monetary Penalty was issued for the following reasons:

• On, or about, November 18, 2013, VIA, Hickling, Lopez and Ambroziewicz, contrary to s. 14(1) and s. 22(1.1) of the Act, offered for sale and sold a new home in Bowser, B.C. (the “New Home”), without being a Homeowner Protection Office Licensed Residential Builder and without the New Home being registered for coverage by home warranty Insurance provided by a warranty provider; and
• The contraventions of the Act by VIA, Hickling, Lopez and Ambroziewicz make them subject to a monetary penalty pursuant to s. 28.3(1)(a) of the Act, s. 20.1(2)(b) and s. 20.1(2)(g) of the Regulations.
