0873123 B.C. Ltd. (“0873123”), Randy Marston (“R. Marston”), and Teresa Marston (“T. Marston”), contrary to sections 22(1) and 22(1.1)(a) of the Homeowner Protection Act (the “Act”), constructed or caused to have constructed a new carriage home in Nanoose Bay, BC (the “New Home”), between the period of, or about, July 6, 2015, and August 4, 2015, and sold the New Home on, or about, August 4, 2015, without the New Home being registered for coverage by home warranty insurance (“HWI”) provided by a warranty provider. On December 5, 2017, BC Housing (“BCH”) issued Compliance Order 17-0044 to 0873123, R. Marston and T. Marston directing that 0873123, R. Marston and T. Marston:
- immediately register the New Home for coverage by HWI provided by a warranty provider pursuant to section 22(1) of the Act; or
- provide BCH Compliance Department with proof that the New Home is currently enrolled in a policy of HWI pursuant to section 22(1) of the Act.
0873123, R. Marston, and T. Marston were ordered to comply with Compliance Order 17-0044 by December 29, 2017.
